April 13 Special Legislative Update

Shenker Russo and Clark LLP Legislative Update

This weekend, the Governor announced that he was amending his Executive Order 202 to provide that, for all essential businesses or entities, any employees who are present in the workplace shall be provided and shall wear face coverings when in direct contact with customers or members of the public. Businesses must provide, at their expense, such face coverings for their employees. Further, that this provision may be enforced by local governments or local law enforcement as if it were an order pursuant to section 12 or 12-b of the Public Health Law. This requirement shall be effective Wednesday, April 15 at 8 p.m.

Today, the Governor held two press conferences regarding the COVID-19 situation. In his morning press conference, the Governor said that the numbers seem to indicate that New York has met its apex and has begun to plateau at that apex. This afternoon, Governor Cuomo held a conference call with Governors Phil Murphy of New Jersey, Ned Lamont of Connecticut, Tom Wolf of Pennsylvania, John Carney of Delaware, and Gina Raimondo of Rhode Island. During the conference call, the Governors announced that they will be working with one another, and a new regional working group, on coming up with a plan to slowly reopen the economy regionally. The regional working group will consist of each Governors’ Chief of Staff, one public health professional and one economic development professional from each state, chosen by the Governors.

We will continue to monitor the COVID-19 situation, and provide you with all the latest updates, including any information the regional working group announces regarding reopening the economy. While the working group spends the next days and weeks determining the best way to reopen the economy, everyone at Shenker Russo & Clark will continue to work closely with you on your issues.
